Description This is a law review article on state laws governing intrafamilial child sexual abuse. It details the multiple types of special, preferential treatment that most state criminal codes give to child rapists who "grow their own victims." It specifically examines the way prosecutors are allowed to charge a perpetrator related to the child victim under the incest laws (resulting in very little punishment,) instead of using child sexual abuse laws (serious punishment). The article includes a blueprint for writing legislation to close these "incest loopholes" in any state. It will be useful to anyone who wishes to ensure that prosecutors do not give a child victim short shrift simply because the perpetrator is a relative.
